HC asks CB to arrest 14 fugitives using proclamation, other methods; denies bail to 15 accused | BOPEE scam: 2 more candidates involved in fraud identified | | Early Times Report srinagar, Mar 20: The Crime Branch of Police has identified two more beneficiaries of multi-crore cash-for-paper scam of Common Entrance Test 2012 even as the J&K High Court directed the Investigation agency to take coercive action against those avoiding arrest in the case. As the hearing in the suo-moto PIL started, the Crime Branch informed a division bench comprising of Chief Justice MM Kumar and Justice Hasnain Massodi 14 persons against whom charge sheet has been filed continue to evade arrest. Advocate General, representing the Crime Branch said Special Judge Anti-corruption at Srinagar has already issued proceedings against them under section 512 CrPC but they have intentionally hiding to scuttle the due process of law and also thwart the implementation of the order passed by High Court. However, he said efforts are on to arrest all the accused evading arrest. The division bench said there is no reason for the Crime Branch not to make use of tools like proclamation and attachment of property provided under Section 87 and 88 Cr.PC. The Advocate General also informed the court that the Crime Branch has identified two more beneficiaries of the scam. However, for the purpose of investigation, he said that their names kept as secret. In another direction, the Division Bench dismissed bail pleas of 15 persons who according to Crime Branch are involved in CET 2012 scam. Apart from this, Division Bench also dismissed petitions filed by two persons--Fida Hussain Lone and Mushtaq Ahmad Kenu--, seeking quashment of proceedings under section 561-A CrPC. Meanwhile, the BOPEE said that it will redraw its list regarding admitting 21 meritorious candidates in place of those whose admission and selection has been cancelled after they were identified as beneficiaries of the BOPEE scam. The submission before the bench was made on behalf of BOPEE by advocate GA Lone who submitted the Board has received reservation from a number of students who are pursuing in SKIMS Bemina and want to study in GMC Srinagar after creation of the vacancies. In its earlier compliance report, the BOPEE had said that in identifying the candidates, it did not take into consideration the merit of the candidates who are pursuing MBBS course in Medical College SKIMS and in Government Medical College, Jammu. This, the BOPEE had said, has been done so as to avoid discontinuity or disturbances in their course of study. |
