Penalty notice slapped against CEO Anantnag | Delay in responding to RTI query | | Early Times Report
Srinagar, June 10: The State Information Commission (SIC) Srinagar office has issued a penalty show cause notice under section 17 of J&K RTI Act 2009 against Chief Education Officer (CEO) Anantnag as he failed to provide information sought by an RTI applicant with the stipulated time of 30 days. As per the details available with Early Times SIC received a complaint from one Ghulam Rasool Bhat R/O Badigam, Shigam Anantnag on 09.05.2014 against Chief Education Officer, Anantnag stating that he applied for certain information under RTI Act 2009 on 07.03.2014 vide postal receipt No. 05F-478231 which was not provided by the concerned officer. The complainant has accordingly requested the Commission to direct the officer concerned to do the needful and also take action against him as warranted under the Act. As per RTI application enclosed with the complaint, the information seeker had sought information on five points in respect of Teachers/Lecturers and related matter. According to the SIC order, " As per evidence brought before the Commission, this RTI application has been disposed of by CEO Anantnag on 28.05.2013 and sent through Registered Post on 29.05.2013.Therefore RTI application has been responded to and sent through proper mode of service. The Commission has however noted that RTI application has not been disposed of within period prescribed under the Act. Accordingly, PIO/CEO Anantnag is directed to explain as to why proceedings under Section 17 of RTI Act shall not be initiated against him for delay in disposing of the RTI application. His explanation should reach the Commission with two weeks from issue of this order. The complainant shall be at liberty to file First Appeal before First Appellate Authority (FAA) in case he is aggrieved by the order of the PIO. |
