Court awards 5 year RI to husband for attempt to murder his wife | | | Jammu, Sept 15 (JNF) : Principal Sessions Judge Jammu RS Jain today awarded five years rigorous imprisonment and fine Rs 50,000 to Vinod Kumar s/o Sham Lal r/o Karwanda Tehsil Jammu who was facing trial for attemptting to murder his wife by sprinkling kerosene on her. According to the police case, a wireless message was received from PCR, Jammu that Poojadevi in a burnt condition is admitted in Jammu hospital. In her statement, she stated that she was married to Vinod Kumar about 5 months ago and one month after the marriage, Vinod Kumar started to harass her. Last night she was sleeping on the roof and when she got up on 30.6.2004, she found that her husband had got up early and gone down stairs. At 6 AM, her husband came to the roof and with an intention to murder her, sprinkled the kerosene oil on her face and set her on fire. On her raising a hue and cry, number of people came on spot. Accordingly, FIR No. 49/2004 for offence u/s 307 RPC was registered in police station Gharota against the accused. On conclusion of the investigation, the IO finding the accused guilty of offence u/s 498-A/307 RPC presented the challan against the accused in court. Principal Sessions Judge Jammu RS Jain after hearing both the sides observed that the accused has been found guilty in attempting to commit murder of his wife and convicted u/s 307 RPC. Keeping in view the facts and circumstances of the case and the arguments advanced by both the sides, accused Vinod Kumar is sentenced to undergo rigorous imprisonment for a period of 5 years and a fine of Rs.50000/- u/s 307 RPC. The fine if realized will be payable to Pooja Devi. In case of default in payment of fine, accused shall further undergo imprisonment for a period of one year. |
