Jammu, Sept 20 : Principal Sessions Judge, Kathua, Vinod Chatterji Koul today awarded 10 years rigorous imprisonment and a fine of Rs 5,000 to two real brothers -- Ravi Kumar alias Raja and Lovely Kumar -- sons of Hans Raj of ward No 15, Kathua, who were facing trial in an attempt to murder case. According to the case, the accused have been prosecuted for offences punishable under sections 307, 326, 323, 341 and 34 of RPC and 4/25 of Arms Act on the basis of a written complaint made by Vijay Kumar on 26.06.2009. Vijay is the brother of victim Rajan Kumar. As per the report, on 26.06.2009 at about 10 PM, Rajan was on his way home and when Ravi Kumar, Lovely Kumar, Reva Rani and Pushpa Devi attacked him and inflicted blows with sword, kirch and fists with intention to kill him. The injured managed to escape from the clutches of the accused and narrated the story to his brother who was home. Both of them went to Police Station, Kathua, and lodged the FIR. The injured was admitted to District Hospital, Kathua, and later referred to GMCH, Jammu. On the basis of the complaint, FIR No. 162/2009 was registered with Police Station, Kathua, and investigation was started. Police after completing the investigation, found the offences punishable under sections 307, 326, 323, 341 and 34 of RPC and 4/25 of Arms Act, established against the accused and accordingly, filed challan before the court of law. The judge, after hearing both the sides, observed that the prosecution established that accused Ravi Kumar and Lovely Kumar had committed offences and were accordingly, convicted. Accused Pushpa Devi and Reva Rani are, however, acquitted of all the charges, as there is no sufficient evidence to prove the charges against them. Accused Ravi Kumar and Lovely Kumar are on bail and their bail is cancelled. They are ordered to be taken into custody and further observed that in view of all the facts and circumstances and while balancing the aggravating and the mitigating circumstances, the ends of justice will be met in case both the accused are sentenced to undergo rigorous imprisonment for a term of ten years and also to pay a fine of Rs 5000 each. The accused shall undergo further imprisonment of six months each. They are further sentenced to undergo imprisonment for a period of one month for offence punishable under section 341 of RPC. They are also sentenced to undergo imprisonment for a period of one year and to pay fine of Rs 1000 each for offence under section 4/25 of Indian Arms Act, and in case of default in paying the fine, the accused shall undergo further imprisonment of one month each. All the sentences, however, shall run concurrently. |
