| Contradicting his previous order, GMC acting Principal all set to adjust blue eyed | | | Arun Singh
JAMMU, Oct 10: It is surprising to find that GMC acting principal Ghanshyam Dev, in contradiction of his previous order, is alleged to be all set to adjust his own men in Medical Faculty Club (MFC).
Early Times had carried a news item in this regard in its October 1 issue under the caption "Nomination of new members raises brows, hierarchy brushed aside, MFC of GMC turns personal fiefdom of blue eyed doctors". In it, it was reported how Dr Ganshyam had unconstitutionally nominated new MFC members bypassing hierarchy just only to adjust Dr Tariq Azad in clear violation of rules.
Sources told said in the recent PMC order Number GMC/order/341 dated 04-10-2014 which is beyond the legal power/authority of acting GMC Principal, pending writ petitions. So it was alleged to be unconstitutional on his part to violate the existing MFC norms and protocol. At the same time the order is self contradictory to his previous order and is alleged to be an act of favouritism to one individual out of protocol, the sources added.
Sources said that recent order showed that Dr Ganshyam has agreed upon the objections in his previous order No. GMC/order/342 dated 20-08-14 after issuing of the current order No. GMC/order/341 dated 04-10-2014.
"The orders issued by Dr Ganshyam were unconstitutional as he has been appointed as in-charge principal vide Govt. Order No.230-HME 2014 Dated 23-04-2014 which is purely a temporary arrangement and it does not provide him any extraordinary power to take any policy decision, which only can be taken at Government level," sources claimed.
They informed that vide SWP no. 2786/2012 title Dr Shashi Gupta V/s State and others wherein, Dr Shashi Gupta (Prof & Head, Department of Obst & Gyane) and Dr Ghyansham Dev, (Prof. & Head, Radio-Diagnosis), GMC, Jammu are locked in litigation regarding the issue of seniority and matter is subjudice before the High Court here.
Moreover vide SWP No. 2650/2012 & CMA NO.4139/2012, 3593/2014, Dr Aniece Chowdhary V/s State & Others an interim order was issued by High Court Jammu on 30/9/2014 which reads as follows: "In the meanwhile, recommendations made by the establishment- Cum Selection Committee dated 18.10.12 shall not be acted upon".
Dr Ganshyam, in its recent order pointed out on the appointment of Dr Zahid Gillani as member secretary and said that the appointment was made bypassing and ignoring the other senior faculty members which is factually wrong.
"At the time of superannuation of then principal Dr Aniece Choudhary as per order number GMC/PS/MCF/2975 Dated 28th April, 2013 appointed Dr Zahid Gillani as Member secretary purely under existing Govt./Institutional/Medical Faculty Club (MFC) rules / laws and protocol and in lieu of SWP no. 2786/2012 title Dr Shashi Gupta V/s State & others, wherein Dr Shashi Gupta Prof & Head Department of Obst & Gyane and Dr Ghysnsham Dev, Prof. & Head Radio-Diagnosis, GMC, Jammu are locked in litigation regarding the issue of seniority and matter is subjudice before the High Court Jammu. He was left with no choice other than to appoint senior most Professor (Dr Zahid Gillani) as Member Secretary MFC/Guest House," they said.
Similarly, Dr Shashi Gupta then principal again followed the existing Govt./Institutional/Medical Faculty Club (MFC) rules / laws and protocol and in lieu of SWP no. 2786/2012 title Dr Shashi Gupta V/s State & others, issued another order in favour of Dr Zahid Gillani as member secretary MFC vide order no.GMC/PS/Order/Committees/3032 Dated 20-05-2013.
Thus, all recent orders by Dr Ganshyam are unconstitutional, and continue to violate existing Govt./Institutional/Medical Faculty Club (MFC) rules / laws and protocol. As the same time these are self contradictory to his previous orders and clear act of favouritism to one individual out of protocol, sources said.
Dr Ganshyam in PMC order Number GMC/order/341 dated 04-10-2014, made attack on Dr Zahid Gillani by mentioning that some malfunctioning has been pointed by various HODs in relation to working of MFC/Guest House.
Sources said that no such complaint has been received if such complaints were made by various HODs then why there was a delay on his part to inform about such lapses to the Administrative department which raises a question on working of office. |
