HC issues directions in allocation of Kerosene Oil as per GOI guidelines

Jammu, Feb 1: In a petition filed by Behari Lal and Ors seeking directions to State CAPD department for allocation of kerosene oil as per Govt of India Guidelines, Justice Janak Raj Kotwal of J&K High Court Jammu Wing after hearing Adv Aseem Sawhney appearing for the petitioner issued four week's notice to the Commissioner CAPD, director CAPD and Ors and directed that subject to objections, respondents are directed to strictly maintain the scheme of allotment as envisaged under the guidelines issued by the Ministry of Petroleum and Natural Gas, Govt of India which inter alia contemplate allocation of Special Kerosene Oil to the level of 250 Kiloliters per month to High Volume dealers in the first instance followed by the allocation to the level of 75 kiloliters per month to the low volume dealers and so on.
The grievances of the petitioners is that the petitioners are amongst the seven High Volume Kerosene Oil dealers- Stockists/distributors for the Indian Oil Corporation Ltd of Jammu province and till the year 1986, when the policy was framed by the Govt of India, Ministry of Petroleum and Natural Gas/ IOCL; the petitioners herein and two more, totalling six were the only Kerosene Oil Dealers, who in technical terms are SKO/LDO dealers (Superior Kerosene Oil ) (Light Diesel Oil) who dealt in the dealership/ distributorship of the IOCL. The allocation of the Kerosene Oil (SKO) was being done by the Indian Oil Corporation amongst all its dealers as per the guidelines/ policies issued and being followed from time to time by the Ministry of Petroleum and Natural Gas till 1996 and in 1996 the allocation of the Kerosene Oil was handed over to the erstwhile Food & Supplies Department (now CA & PD Department). The Food & Supplies Department allegedly started allocating the Oil as per their whims, fancies and arbitrariness and on the basis of favoritism and extraneous considerations. Since there were heart burns and complaints of arbitrariness therefore the Sr Divisional Manager , Indian Oil Corporation who was the State Level Coordinator J&K wrote a communication to the Commissioner/ Secretary to Govt Food, Supplies and Tpt Deptt in this regard. That as per the communication the said officer informed that the Ministry of Petroleum and Natural Gas, Govt of India has issued policy guidelines for allocation of the Oil. (JNF)
