DB directives to fill up posts of Dy Controller Drugs

Jammu, Feb 18: In an application filed by State in that they have taken various steps for ensuring the compliance of the direction as contained in the judgment dated 24.11.2014 regarding fillup the posts of Dy. Controller Drugs.
Division Bench of State High Court Comprising Justice Mohammad Yaqoob Mir and Justice Bansi Lal Bhat observed that In terms of the judgment impugned dated 24th November, 2014, the respondent-State was under command to take steps to fill up the posts of Dy. Controller Drugs and Controller Drugs on substantive basis strictly in terms of the rules within a period of three months with a further direction that the arrangement ordered by virtue of Government order bearing No.550-HME of 2014 dated 01.10.2014 allowing the respondents to function as Incharge Controller Drugs and Food Control Organization shall cease to exist by the20th February, 2015. Within these 3 months, the official respondents shall initiate steps to finalize the promotion at the level of both Dy. Controller Drugs and equivalent grades as also against the post of Controller Drugs J&K on substantive basis. Till then respondent No.2 (Nazir Ahmed Wani) to continue to act as Incharge Controller Drugs and Food Controller Organization as ordered by virtue of order date 01.10.2014.
Division Bench further observed that Instant application has been filed by the State stating therein that they have taken various steps for ensuring the compliance of the direction as contained in the judgment dated 24.11.2014, but the Public Service Commission being without the Chairman as well as the Members has disabled the State in taking the final decision. It being so, some time has to be extended so as to enable the State to ensure compliance of the directions as issued on 24.11.2014. Advocate Rahul Pant would submit that the matter is being prolonged to the disadvantage of Ms. Lotika Khajuria.
Division Bench after considering the submissions, the uncertain situation is that the Public Service Commission is without Chairman and the Members, so there is genuine difficulty for the State in implementing the judgment. In order to safeguard the interest of both the parties, it would be appropriate to extend the time by two months or till the appeal is disposed of or any further order is passed in the appeal, whichever is earlier till then arrangement made will continue and disposed of the application.
