Noted Pvt hospital operating without SMC's permission

Srinagar Mar, 28 : A noted private hospital is operating without the permission of Srinagar Municipal Corporation (SMC) in Srinagar's posh residential colony from the last more than a decade. The documents about the permission granted by SMC were sought by an RTI applicant.
Details available with Early Times reveal that one Abdul Rashid Khan filed an RTI application before PIO Srinagar Municipal Corporation (SMC) on 26-08-2014, seeking information regarding building permission of classic Health Science Training Centre and its student hostel at Gulberg Colony, Hyderpora, Bye-pass Srinagar.
The PIO passed order on 07-11-2014, enclosing therein, copy of communication of Jt. Commissioner (Planning), SMC under No. SMC/BS/28 dated: 01-11-2014. The order though passed late, but as the period when RTI has been filed was of severe floods in Srinagar, wherein many office accommodations were submerged including SMC too, hence no action to be taken for not passing order on time.
Having not satisfied with the order of PIO, the appellant Abdul Rashid Khan preferred first appeal before First Appellate Authority (FAA) , SMC on 19-11-2014, received in his office on 21-11-2014. The FAA has disposed of this appeal vide his order dated: 20-12-214. However, this order has been passed without giving an opportunity of being heard to the appellant. The appellant again not being satisfied with the order of FAA, filed 2nd appeal in the State Information Commission (SIC) on 29-01-2015, wherein, it was submitted that information provided by PIO is not in accordance with his RTI application under appeal before the Commission. The Chief Information Commissioner (CIC) G R Sufi heard both PIO as well as the appellant during the case hearing recently at Srinagar . The Commission perused the order of PIO, which has been provided to the information seeker against his RTI application, wherein PIO has intimated the appellant that on the basis of record, no permission has been granted in favour of Classic Hospital. The appellant stated during the hearing that he wanted information with regard to building permission if any given to Classic Health Science, Training Centre, Gulberg Colony, Hyderpora, Bye-pass and building permission if any given to Students Hostel Building of Classic Health Science, Training Centre, Gulberg Colony, Hyderpora, Bye-pass Srinagar and not the Classic Hospital. SIC directed PIO, Srinagar Municipal Corporation to provide information to the information seeker in accordance with his RTI application within 05 days of the receipt of this order, under intimation to this Commission
