Molestation of female patient by doctor

Srinagar, Aug 28: The State Information Commission (SIC) has directed the Sher e Kashmir Institute of Medical Sciences (SKIMS) Srinagar to reveal the details especially the action taken report vis a vis molestation of a female patient by a senior doctor working in the institute some time back.
Details available with Early Times reveal that one Dr G N Yatoo a resident of Humhama Budgam had sought following information under J&K RTI Act 2009 from Public Information Officer (PIO) of SKIMS .
Action taken by the SKIMS administration after the molestation charges with the female patient against the concerned doctor were proved by the enquiry committee; service records of the said doctor from his service book to verify the entry of records regarding the penalty imposed on him by the SKIMS administration; annual performance reports (APRs) of the said doctor on the basis of which he has been getting promotions despite such heinous charges which have been proved against him.
The PIO passed an order on 10.2.2015 denying the information to the information seeker invoking section 8(1)(i). Being aggrieved by the denial of information, the appellant preferred first appeal before the First Appellate Authority (FAA) on 19.2.2015 praying for a direction by the FAA to the PIO SKIMS to "release the information sought as section 11 was not applicable in the instant case.
Again being aggrieved by the cryptic order of the First Appellate Authority (FAA) of SKIMS , the appellant Dr G N Yatoo preferred second appeal before the State Information Commission (SIC) on 8.5.2015 requesting the Commission for a direction to the PIO to disclose the information.
The Commission then adjudicated the issue raised by the appellant in his RTI application.
The order issued by larger bench of State Information Commission (SIC) under Chief Information Commissioner G R Sufi and Information Commissioner Nazir Ahmad directed the SKIMS authorities to reveal details under RTI to the appellant Dr G N Yatoo except the copy of service book which according to SIC was not givable . While passing the orders the SIC's larger bench observed, " The uncivilized conduct with a lady patient " is a scar on the attributes of a civilized society. The respect and honour to be given to mothers, sisters and daughters i.e women folk has not only to be an article of faith but a day-to-day practice while living in a civilized and dignified society. The respect and honour to women is not only enshrined in religious scriptures, the secular laws and statutes are also not lagging behind. Almost all civilized world has ensured "fundamental rights to its citizens, gender equality is an integral part of these rights. It is not enough to say that right to life is secured. It should mean right to life with dignity and honour."
