Early Times Report Jammu, Nov 25: A high court division bench of Justice Bansi Lal Bhat and Justice B S Walia today granted bail to Radhey Sham who was convicted and awarded life imprisonment in a murder case by the trial court. According to the police case, a written report came to be lodged by the complainant on November 4, 2007 in which it was alleged that he had a long standing land dispute with Som Raj. A few days before he permitted installation of a BSNL tower on his land, Som Raj opposed the move and even allegedly issued life threats to him. On the fateful day, Vijay Kumar was returning home after attending a marriage ceremony in the house of Gian Chand when the accused allegedly attacked him. While two of the accused allegedly caught hold of Vijay, the third attacked him with a sharp edged weapon, injuring him seriously. Jyoti Prakash, who reached the spot, raised an alarm but the accused fled the spot. Vijay later succumbed to his injuries. Police registered a case in this connection and after completion of investigation, presented challan in the court. After hearing the two sides, the court observed that on consideration of the facts and circumstances of the case, it was of the considered opinion that in view of enlargement of appellant Som Raj on bail with reference to his role in the alleged occurrence, petitioner Radhey Sham to whom the same role is ascribed, cannot be denied the concession of bail on the ground of parity. With these observations, the court allowed the bail application and granted bail. |
