Jammu, Jan 24: The State Information Commission (SIC) has directed the Jammu University authorities to allow inspection of all the relevant documents pertaining to stopping of GP fund subscription of applicant's wife.
Details available with Early Times reveal that one Kamal Sangra a resident of Shastri Nagar, Jammu being aggrieved by the decision of the Public Information Officer (PIO) and First Appellate Authority (FAA), University of Jammu, filed 2nd appeal before J&K State Information Commission (SIC) on 17.12.2015 stating that the GP Fund subscription of his wife Dr. Sapna Sharma was suddenly stopped by University of Jammu authorities in April, 2009 without any order.
The information under RTI Act in this regard, was sought through post, from the University of Jammu on 14th July, 2015, which as per the tracking system of Postal Department, GOI website, was delivered to the University on 16th July, 2015. As no reply was received from the PIO, 1st appeal was made on 01.09.2015 before the Registrar, University of Jammu,. As a damage control, PIO sent information on 04.09.2015. Not satisfied with the reply of PIO, the applicant again made an appeal to the FAA (Registrar) on 09.09.2015, but the FAA without enquiring the deliberate delay in the reply by the PIO, expressed his satisfaction over the reply. The appellant after filing 2nd appeal before SIC prayed that
(b) University authorities be directed to provide copy of the order videwhich GPF subscription of Dr. Sapna Sharma was stopped along with the note-sheet of the relevant file.
The PIO has given reply to part (b) of prayer by forwarding information provided by Deputy Registrar (Accounts/Adv.) dated: 17.08.2015, stating that as per records available, GPF Fund subscription in favour of Dr. Sapna Sharma has been stopped from the month of April 2009. Further, informing that no record is available/traceable vide which G.P. Fund subscription was stopped.
SIC order dated 15.1.2016 reads as :
"After considering the prayer/argument of the appellant and reply of the PIO referred to herein above, the Commission is of the view that information, as available on record, has been conveyed to the appellant within the definition of information, which means any document available on record as held by the public authority. However, to satisfy the doubts of the appellant and upholding the spirit of transparency, the Commission directs PIO-II, University of Jammu, to allow the appellant inspection of relevant records, for which a suitable date, time and venue be intimated to the appellant within 10 days. A compliance report in this regard be submitted to the Commission. The appellant further argued that there is delay in providing the information on the ground that RTI application was delivered to the University on 20.07.2015, as per communication of Sr. Superintendent of Post Offices (CPIO), Jammu Division, Jammu submitted to the Commission. Since PIO has not explained delay, Dr. Rainoo Bhai (PIO-II), Assistant Registrar, University of Jammu, Jammu is given an opportunity to explain delay within 02 weeks so that Commission can take a view on further proceedings accordingly" |
