Govt formation: BJP toying with the idea to stake claim

Srinagar, Feb 4: As the suspense over government formation is continuing, the Bharatiya Janata Party (BJP) is reportedly toying with the idea to stake the claim for government formation in Jammu and Kashmir as BJP is the second largest party with 25 seats.
Sources said a few BJP leaders are of the opinion that if its former ally Peoples Democratic Party (PDP) says goodbye to the party then BJP should approach the Governor and stake the claim to form the government and seek two months from the Raj Bhawan to prove the majority at the Floor of the House.
Sources claimed that BJP has the support of 30 MLAs and it needs 14 more MLAs to touch magic figure of 44 MLAs. "If we form the government we will be in a better position to bargain with the regional parties," they claimed.
Insiders said that party is also toying with the idea of projecting Muslim face to be sworn in as the Chief Minister but party has no Muslim leaders except Hina Bhat and the party spokesman Khalid Jehangir. Hina Bhat contested 2014 Assembly polls unsuccessfully from Amira Kadal constituency, while Khalid Jehangir, who is considered pro-RSS and a hardliner, is yet to prove his mettle. "Top BJP leaders have opposed the idea tooth and nail. They want someone from the Jammu region to come forward and be a part of the experiment which can go either way round," sources claimed.
Insiders claimed that BJP leaders have conveyed their idea to National Conference leaders through back channel are trying to seek a favorable response from their side. "If NC comes forward and supports the BJP at the Floor of the House it can make the idea work. We can first form the government and then prove the majority at the Floor of the House," sources claimed.
They said a few NC leaders are ready to support the BJP but a group within the NC is opposing the idea. "NC leaders at present are non-committal as they believe that BJP-PDP alliance is still intact. These 10 days are very crucial for the BJP. If we are able to rope in NC then midterm polls can be avoided," the source added.
He claimed that options are being explored as PDP seems in no mood to compromise. "Top BJP leaders not responding to the issues raised by the PDP is a clear indication of the fact that Centre is not ready to give anymore concessions to PDP. Politics is the art of possibilities and we are exploring every possible way to end the stalemate," the source added.
Constitutional experts believe if the single largest party does not come forward to form the government the Governor can invite the second-largest party in the House to form the government and give them time for the vote of confidence. The experts quote the Supreme Court ruling in the S R Bommai versus the Union of India case delivered in March 1994.
If PDP leadership stays reluctant, the Governor has authority to invite BJP to form the government. Experts are of the opinion that if BJP has no confidence vote, the House could be dissolved and the BJP chief minister could continue to serve as the acting chief minister till the next elections are held in the state.
