Jammu, Feb 5: Presiding Officer of Fast Track Court, Kishore Kumar today awarded 15 years of rigorous imprisonment to a man for raping a minor. Yash Paul, son of Chaman Lal of Talhar, R S Pura, was facing trial in kidnapping and rape of minor since 2013. According to the police case, Dharam Paul Singh lodged a written report with police on September 6, 2013, alleging therein that his 15-year-old daughter, who had gone out of their home to attend nature's call, had not returned. He said while searching for her, he came to know that she had been abducted by Yash Pal of Talhar. Taking cognizance of the report, police registered FIR under section 363 of RPC. During investigation, police recovered the girl from the possession of Yash Paul. Her statement was also recorded under section 164 A of Cr P C. Her medical examination at the government hospital, R S Pura, confirmed that she had been raped twice by the accused at his residence The fast track court presiding Officer, after hearing the two sides, observed that the offence of rape was barbaric in nature. "Inspite of the minority of the girl, the convict committed the ghastly, abominable, inhuman and barbaric act of rape upon her, violating the Privacy of the minor girl and giving her and her family a lifelong trauma. In case of injury to a woman one can forget after some time but the act of rape cannot be forgotten till the victim is alive and she has to face humiliation in the society as well as in the family," he said. With these observations, the court awarded rigorous imprisonment to the accused for a period of five years along with a fine of Rs 5,000. In case of default thereof, he would further undergo rigorous imprisonment for a period of six months under section 363 of RPC. He was further sentenced to undergo rigorous imprisonment for a period of 10 years and directed to pay a fine of Rs 50,000. In case of default thereof, he would further undergo rigorous imprisonment for a period of one year under section 376 of RPC. All the sentences shall run concurrently, the court directed. (JNF) |
