HC concerned over lack of paraphernalia in J&K under FSSA

Srinagar, Apr 25: The state high court today expressed serious concern about the state of affairs in J&K after it was informed that there was no paraphernalia available under Food Safety and Standard Act (FSSA) 2006 in the state. "The statement made at bar by the respondents' counsel and food safety commissioner is enough to shock conscience of every sensitive soul that there is no paraphernalia available in J&K in accordance with the FSSA mandate," a high court division bench of Justice M H Attar and Justice A M Magrey observed while hearing a suo-moto PIL."There is no testing laboratory worth the name under this Act in J&K. It appears that people of the state are made to consume adulterated food. All those, who are responsible to check this adulteration, probably have forgotten to perform their statutory duty," the bench said and questioned as to who will compensate those suffering from chronic diseases due to the consumption of adulterated food.
Earlier, the health department filed a compliance report but after its perusal, the bench said that it did not comply with its directions issued on the previous hearing. "The respondents to respond to the suggestions placed on record in writing by amicus. They shall also give full details about the issues raised on last date. The details shall be provided by or before the next date," the court said and posted the PIL for further consideration on April 27next. Last week, the bench had directed government to provide details about how many convictions had been recorded by the competent court on the complaints filed under FSSA. It had also directed the government to furnish details about the number of laboratories along with their location in the state.
The government was also directed to provide details about the number of officers and officials, who were required to be posted under FSSA and how many of them were in place in both divisions of the state.
The bench also sought full particulars of all those persons, companies and corporations, who were manufacturing or processing any products in the state.
The amicus curie in the PIL had sought direction to the government to furnish among others details regarding district-wise number of recognised scientific food-testing laboratories with requisite machinery and equipments, staff strength as well as number of food safety analysts along with their qualifications.
