Jammu, Apr 27 :- The Chief Judicial Magistrate Kishtwar, Balbir Lal Jaswal today rejected the bail application of an army personnel who has been arrested by Kishtwar police in FIR No: 145/2015 registered under section 306/498 RPC.
As per the details available with "Early Times", the contents of said FIR reveals that one Satish Kumar Son of Hukam Chand Resident of GangnaTagood , Tehsil Mughhalmadian in District Kishtwar deposed before the police that his marriage was solemnized with Gita Devi (now dead) daughter of Bansi Lal resident of Basdevna and had three female children born out of said wedlock added that he was living peacefully with his wife; but one Randeep Singh Son of Dhani Ram resident of GangnaTagood who happens to be a serving army man of 12 JAKLI enticed his wife and developed illicit relationship with her, on which she started quarrelling with him leading to constrained relations.
The complainant revealed that 0n 03.08.2015, his deceased wife disappeared from his home and was told by the locals that the accused Randeep Singh and his deceased wife was living together when on 11.08.2015; he was told by one Om Parkash that his wife Gita Devi committed suicide by jumping into River Chenab at Bhandarkoot. After reciving the information about his wife committed sucide, the complainant approach the police and registered FIR against the accused army personnel who was later arrested by the police.
As per the inquiry report, police during its investigation found that said Gita Devi was raped by Randeep Singh son of Dhani Ram resident of GangnaTagood, Tehsil Mugalmaidan continuously from last 4 to 5 years on the assurance that he will marry with her. Police investigation reveals that when she left the association of her husband and asked said Randeep Singh to solemnize marriage with her, the accuse refused to marry with her and told her that he was just fluttering with her; on which she were left with no other option except to ending her life added that the deceased took this drastic step of ending her life on the circumstances and atmosphere created by said Randeep Singh.
The CJM while passing the orders on bail application observed that the lady has lost the life by the act of accused and accused has been arrested after more than 7 months.
"The involvement of the accused is yet to be determined by holding the full dress trail. At this juncture court is inclined to express his view whether the concession of the bail favours the accused or not. The accused indeed involved in the commission of the offence where a young lady has committed suicide not only the lady has committed the suicide, but her three minor children's has been deprived the motherly affection by the act of the accused, thus cannot lost sight off" find the court. The CJM Further observed that if the accused is involved in the commission of the offence which carries either capital or life imprisonment and causes an eye sore or stigma upon the social order, the personal liberty has no preference as it is not for the sake of glamorizing and it should be for the sake of restoring the public confidence upon the temple of justice.
"If the accused who is involved in the serious crimes are granted bail, the routine manner and a pave of discontentment among the society shall be waved which is never be the object of the criminal court. The court has to decline the menace of crime" CJM maintained. After referring several judgments of High courts and Apex Court, the CJM Kishtwar rejected the bail of accused who is presently under police custody.
