Govt departments lack will to fight legal cases
'Corrupt officers ruling the roost'

Srinagar, Aug 21: The connivance of the corrupt officers of the department of Industries and Commerce with those who derived illegal benefits at the expense of public exchequer is giving a lose rope to the latter in the ongoing legal cases against them.
Official sources told Early Times that the level of non-seriousness on part of these officers can well be gauged from the fact that the industries and commerce department has purposely and intentionally not shown interest to fight a demotion case of three of its officers in the court, where by it has taken a toll on the government chest and has put extra financial burden without any budgetary provision.
The National Conference led government under the then MOS industries and commerce Sajad Ahmad Kitchloo elevated three blue eyed junior general managers to the post of managing directors. The orders of elevation were found defective and legally not sound; therefore the government demoted two of them back as general managers.
However these officers went to the court and obtained a stay for protection of their salary attached to the post of MD.
Sources said that now these officers after taking refuge of the stay are drawing salaries of salary of MDs.
In the said stay order, Minister for Industries and Commerce, commissioner secretary industries and commerce and two incumbent Managing Directors were made respondents with instructions to file objection.
Sources said that however it took one and a half long year to frame the objections and file them in the court of law against the stay.
The sources further stated that now there is no follow up of these cases by the legal section of the industries and commerce department as a result till date, these corrupt officers are being given the salary of MD.
Apropos the news item published in this paper about the withdrawal of the Grade of MD handicrafts, the said incumbent MD has also obtained the stay from the court for pay protection and is also taking refuge of the stay order.
It is retreated that the incumbent MD handicrafts was also elevated as Managing Director out of rules and out of turn.
Meanwhile if source are to be believed, a Cabinet Minister had shown inclination to rehabilitate one of the demoted officers by elevating him to the post of MD, however reportedly the Chief Secretary and commissioner secretary industries and commerce turned down the proposal.
The industries and commerce department is a composite head of many departments/corporations working under the control of commissioner secretary industries and commerce.
It has been learnt that the legal section of industries and commerce department at civil secretariat and similar section at one of the PSU's lack will to fight such cases; as a result, the undue benefit continues to percolates to these demoted officers.
Sources said that Similar is the case of incumbent in-charge Managing Director JK cements who was promoted as General Manager while on deputation.
Sources said that few of the officers of his parent organization who claimed seniority to him went to the court of law seeking justice.
However sources said that his parent organization was to file objections but did not prefer to respond up to last two years with the results the court had to repeatedly issue instructions to the corporation for filing objections.
