Embezzlement of food grains

Jammu, Nov 22:Crime Branch, Jammu has produced challan in case FIR No. 19/2009 u/s 409,120-B RPC r/w Section 3/7 E.C. Act and 5(2) PC Act Svt.2006 P/S Crime Branch, Jammu against the accused persons namely Ghulam Rasool Sheikh S/o Abdul Ahad Sheikh R/o Hablich, Kulgam, then I/c Supervisor CA&PD Godown Vailoo, Anantnag, Ghulam Hassan Shah S/o Ghulam Mohammad Shah R/o Bachoo, Anantnag, then Storekeeper CA&PD Godown Vailoo, Anantnag and Farooq Ahmad Reshi S/o Ali Mohd. Reshi R/o Larsoo Bren Nar,Kokernag, then Storekeeper CA&PD Godown Inshan Guzar, Kishtwar in the Hon`ble Court of Special Judge, Anti Corruption, Jammu today on 22.11.2012.
Instant case was registered on the recommendation of a committee of officers constituted by the Government regarding embezzlement of huge quantity of food grains. As per the preliminary enquiry report of the committee constituted by the Government, huge embezzlement of food grains was detected which was caused by the concerned staff of CA&PD Department by showing fictitious dispatches from Vailoo and Inshan Guzar Godowns during the financial year 2008-09. The embezzlement of food grains for this period has accordingly been worked out by enquiry committee at penal rates i.e Vailoo Godown Rs. 11, 38,347.54 Lacs and Inshan Guzar Godown Rs. 19,19,321.51 Lacs, aggregating to Rs. 30, 57,669.05 Lacs.
During the course of investigation, it was found that the misappropriation/ embezzlement had taken place by sheer abuse of official position by the officers/officials of CA&PD Department, Anantnag. On the basis of scrutiny of seized records and statements recorded during investigation, the Department of Consumer Affairs and Public Distribution System Deptt. was supplying the ration to general public under APL (Above Poverty Line), BPL (Below Poverty Line), Antodaya (for widows, disabled, landless and poorest of the poor people) and Annapurana (for orphans and destitute).The distribution was being made through ration dealers duly licensed by the Department under the direct supervision of Supervisors/ Inspectors/ Supply officers and concerned Dy.Assistant Directors of CA&PD. These food grains were being dispatched to various locations from District Hqrs. by engaging carriage contractors through road transport as well as pony/ mules etc. The twin blocks of Wadwan and Marwah are located at the remotest end of District Kishtwar having approach both via Kishtwar as well as via Anantnag. During the investigation, it has been found that there was a misappropriation of huge quantity of Rice, wheat and sugar by the officials of the Vailoo Godown itself. In this connection the seized records revealed that two different yearly statements had been prepared which were signed by the supervisor and store keeper of Vailoo Godown, but none of these statements tallied with the monthly grain bag statement as well as stock registers which clearly indicated that both the statements were concocted. The bill credits were prepared on the basis of actual receipts at receipt points and the statements/recommendations made by concerned TSOs which clearly substantiate the misappropriation and embezzlement of food grains meant for the rationees of Marwah Block by the concerned Storekeepers of Vailoo and Inshan Guzar by hatching a well planned criminal conspiracy.
From the evidence, oral as well as documentary, collected during investigation of the case, the accused persons were found to have committed the above mentioned offences and have been challaned before the Hon'ble Court of law for judicial determination. The next date of hearing in the case has been fixed on 24.12.2012.
