| LeT Commander acquitted as prosecution fails | | | Early Times Report
Jammu, Dec 11(JNF): Principal Sessions Judge Poonch Kishore Kumar acquitted Mohd Taj S/O Mohd Yousaf R/O Marrah Tehsil Surankote, District Poonch an alleged Commander of LeT outfit in murder case as prosecution failed to prove its case. According to the police case, on June 7, 2004 police station Surankote received an information that Mushtaq Ahmed SPO S/O Nazir Hussain R/O Khaitan Draba, was deputed at Village Khaitan Draba along with two other SPO's and deceased Mushtaq Ahmed along with two other SPO's was sitting in his house at Khaitan Draba and at about 12.30 AM militants including Mohd Taj entered inside the house. Accused Mohd Taj was accompanied by 5/6 militants. They started indiscriminate firing and one bullet hit the head of SPO Mushtaq Ahmed who died on the spot and the other two SPO's ran away from the spot to save their lives. Upon the receipt of said information police lodged a FIR No.84/2004 for the commission of offence u/Ss 302/120-B/121/122/RPC and 7/25/26/27 I.A.Act and after completion of investigation presented challan in the Court of law. Principal Sessions Judge Poonch Kishore Kumar after hearing Public Prosecutor Nazir Hussain appearing for the state whereas Adv Taj Hussain Shah and Mohd Maroof Manhas appearing for the accused persons, observed that Having carefully examined the prosecution evidence and after giving the thoughtful consideration to the submissions made by the Public Prosecutor and defence counsel Court is satisfied that there are so many material contradictions and serious infirmities in the statements of prosecution witnesses. Hence accused Mohd. Taj is acquitted of the charges framed against them. |
