Alleged militants acquitted of murder charges as prosecution fails

Ramban, Jan 17 (JNF): Principal Sessions Judge Ramban M.A Chowdhary has acquitted two alleged militant namely Mumtaz Ahmad alias Asif Comm-ando S/O Haleem Gujjar R/O Hara and Manzoor Ahmad alias Furqan S/O Gh. Mohd Naik R/O Dalwa Gool in double murder case as the entire case has been investigated recklessly by the investigation agency.
According to police, On the basis of information received at Police Station Gool that in the intervening night of 10th and 11th of June 2007 some unknown militants armed with weapons intruded into residential house of one Mohd Saleem S/O Abdul Rashid Bhat R/O Moila and fired indiscriminately resulting into the death of Mohd Saleem and serious injuries to his wife Tarmeem Begum and that the deceased and the injured were lying on spot and the militants had escaped, Gool Police registered a case vide FIR No. 42/2007 for the commission of offences punishable under sections 302/307 /458/121-A RPC and 7/27 Arms Act. After investigation of the case the instant charge-sheet was laid for the commission of offences punishable under sections 302/458/121-A RPC and 7/27 Arms Act against Mumtaz Ahmad code Asif Commando S/O Haleem Gujjar R/O Hara and Manzoor Ahmad Code Furqan S/O Ghulam Mohd Naik R/O Dalwa Gool Tehsil and District Ramban.
Principal Sessions Judge Ramban M.A Chowdhary observed that head constables Gh. Hassan Bhat and Wazir Mohd are the two IOs of the case who have not deposed anything about the recording of the statement of injured Tarmeema Begum who later died and her statement could have been a dying declaration. The prosecution has not placed on record any such dying declaration alongwith the chargesheet. The entire case has been investigated recklessly by the investigation agency.
Court further observed that this is how a case of double murder has been dealt with by irresponsible and incompetent Police Officers. Court further held that the prosecution has miserably failed to bring home the charge against the accused.
The prosecution case fails and is dismissed and accused are acquitted of the charges.
