Rigorous life-imprisonment to maternal grand-father for raping one year old

udhampur, Jan 17 (JNF): Principal Sessions Judge Udhampur AK Koul today awarded rigorous life-imprisonment and fine of Rs 10,000 to Bodh Raj S/O Milapu alias Billa R/O village Dhanori near Birma Bridge Tehsil and District Udhampur who committed rape with her one yr old grand-daughter.
According to the police case, a written report was lodged by the father of victim in P/S Udhampur on March 11, 2012 that he alongwith his family was living in the house of the grand father of his wife. The minor daughter of the informant (hereinafter referred to as victim) aged one year spent most of the time with the grandfather of her mother. On the fateful day accused, who was also the maternal grandfather of the victim, took her along to his home in the close vicinity at around 12.30 noon. Immediately thereafter the victim started crying. Prosecution Witness Kajal heard her cries and rushed to the room of accused but the accused ran out of the room. The victim was lying on the bed in a pool of blood. She was bleeding per vagina. The circumstances prevailing suggested that accused had raped her. On the basis of this written report a case was registered against the accused u/s 376 RPC and accused was arrested and after completion of the investigation challan was presented in the Court of law.
Principal Sessions Judge Udhampur AK Koul today after hearing Public Prosecutor Naveent Gupta appearing for the state whereas Adv Ms Sumiti Sharma appearing for the accused observed that an unfortunate aspect in our country is that a girl child is very vulnerable and one of the prominent ways of her exploitation is rape besides other modes of sexual abuse. Court while convicting the accused u/s 376(2) (f) of RPC and sentenced Bodh Raj rigorous imprisonment for life and also to a fine of Rs.10,000/-. In default of payment of fine he shall undergo a further imprisonment for six months and also ordered that the case file shall be submitted to High Court through Registrar Judicial Jammu and the sentence imposed on accused shall remain in abeyance till it is confirmed by the High Court.
