| JKPCC authorities fail to implement Court orders | | Promotion in violation of norms | | Majid Ahmad srinagar, Jan 25: Throwing all rules and norms to winds, authorities of Jammu and Kashmir Projects Construction Corporation (JKPCC) have failed to implement a stay order granted by High Court in an out of turn promotion case of a senior engineer of the Corporation. Sources said Mohammad Abass Lone who is presently working as Deputy General Manager (DGM) in the Corporation was regularised as Deputy Manager in 1996 and subsequently given retrospective benefit of regularization with effect from 1993. "He was promoted as a manager superseding as many as 10 degree holders who were appointed much before him in JKPCC," they said. "In a clandestine manner one order was issued by then Managing Director (MD) in 1997 vide order dated 31/10/97 where Lone was promoted as manager. In 2003 Lone with the help of the then MD and then R&B Minister got a proposal approved for his confirmation as Manager retrospectively from 31.10.97 which was done secretly in exchange of huge monitory considerations," sources alleged. Immediately when order to this effect surfaced the aggrieved engineering staff of the JKPCC filed a writ petition before the High Court in SWP No 1533/2004 titled Imtiyaz Khaliq Bhat and others versus JKPCC. The High Court after hearing the case issued an order staying the said order of retrospective confirmation of Lone as Manager from 31.10.1997 by virtue of which his position was reduced to the post of Deputy Manager only. "Surprisingly the stay order was never implemented by the authorities in JKPCC because the relevant case file was taken away from the records by the beneficiary. Due to this then Managing Director JKPCC Dilip Thusoo forwarded his case to PWD authorities in 2007 for placing Lone as incharge Manager ignoring the fact that his order of promotion as Manager with retrospective effect from 31.10.1997 was already stayed by the High Court. He had to be reverted back to the post of Deputy Manager which was not done deliberately by Thusoo," a senior official of the Corporation revealed. "Despite the stay orders which exist even on date, Lone enjoys the status of Executive Engineer as incharge DGM of Unit-I, Srinagar and the authorities concerned are maintaining complete silence on the issue on malafide considerations," he alleged. Lone had filed an appeal before the High Court at Srinagar which was dismissed. "The JKPCC higher ups are shutting eyes about the serious matter which not only tantamount to the contempt of Court but also smacks of involvement of huge kickbacks to babus and mantries at the helm of affairs," the official alleged. "Lone wants to reach higher positions by adopting same means and methods as was done by Thusoo," he claimed. |
