| Unfair trade practices, deficient services by school | | | Jammu, Feb 12 : President Consumer Forum Jammu Bala Jyoti (District and Sessions Judge) has directed "Aglow Kids School" to adequately compensate a complainant Dharmender Singh for un-fair trade practices and deficient services. The Forum which consisted of Bala Jyoti and member K D Sharma observed that welfare of the children was a paramount consideration and any hindrance in the same shall be dealt with iron rods. The Forum held that right to education coupled with right to good health is a sine-qua-non for school authorities as well as for the parents. If the educational institution fails to take adequate care to protect the school wards from hazardous atmosphere like in the present case they are accountable of deficiency in service and un-fair trade practice. The complainant had submitted that his son was ill treated on account of health/ education in the school. The Forum held that it has been established against the school that the atmosphere was not congenial for the welfare of the child as the construction was going on during school time and even the child of the complainant was also hit by iron rods scattered therein due to which he got injured. "He even on numerous occasions suffered bad cough and cold on account of dust of the construction going on in the school premises and on requesting to the school authorities both father and child were ill treated, abused and the Principal forced him to remove his child from his school. Being aggrieved of the misconduct of the school authorities a case of un-fair trade practice and deficient services was filed before this Forum," it said. The Forum after consideration of facts and circumstances directed the school authorities to pay Rs11000 as admission fee in the new school and Rs 10000 as compensation/ damages to the victim. (JNF) |
