| Court rejects bail of narco smuggler | | | EARLY TIMES REPORT Jammu, Feb 12 (JNF) : Principal Sessions Judge Kathua M K Hanjura has rejected the bail application of one Surinder Singh who was alleged involved in NDPS Act. According to police on the day of occurrence, Surinder and his associate Manjeet Singh ran after seeing a police party. "They were apprehended and on their search the capsules of Parvan Spas in the quantity of 950 were recovered from Manjeet and 60 capsules of the similar make and brand were recovered from the petitioner. A FIR was lodged and petitioners were arrested," police said. The court after hearing Advocate TN Gupta for the petitioner whereas PP Ravi Gupta for the state observed that looking into the instant petition from perspective of what is stated in the notification, the entire mixture or substance of a particular drug is relevant for determining the quantity of drug and not its pure content. The capsules were allegedly recovered from the accused and it falls within the scales of commercial quantity and this attracts the bar created by section 37 of NDPS Act. With these observations court rejected the bail application. |
