| Court acquits accused from murder charge | | | Early Times Report
Jammu, Feb 14 (JNF) : Principal Sessions Judge Kathua MK Hanjura has acquitted one Dharminder Singh who was facing trial for committing murder of one Sahil s/o Kuldeep Raj who died under suspicious circumstances. According to the charge-sheet the cause of death of the deceased could not be ascertained immediately. The Proceedings under section 174 CrPC were initiated to find out the reason that led to the death of deceased. During the proceedings it was found that accused had taken liquor in the company of the deceased. The deceased vomited it out. The vomited contents were seized by the police. These were sent to chemical examination. No poison was detected in them. The report of CFSL Chandigarh however revealed that organophosphorus insecticide was found on the clothes and the glass bottle containing liquid. The commission of crime was traced to the accused and a case was registered u/s 302 RPC and after completion of the investigation challan was presented. Principal Sessions Judge Kathua M K Hanjura after hearing PP Ravi Gupta for the state and Adv Kirty Bhushan appearing for the accused observed that it was on rising from the deep slumber that the wearing apparals of the deceased were sent for chemical analysis after 56 days from the date of occurrence. It creates a huge doubt whether these clothes remained lying unhampered and intact for a period of 56 days. It sows the seeds of suspicion into the entire prosecution case, and, therefore, the chances of the false implication of the accused cannot be ruled out. It makes the confession also susceptible to suspicion. |
