Jammu, Mar 4: In a Public Interest Litigation (PIL) against alleged illegal construction by land mafia, Division Bench of State High Court Monday observed that the status report as per order dated February 11, 2013 has not been filed nor any information with regard to sanctioning site plans under the Municipal Corporation Act or completion certificates issued in respect of any completed buildings has been given.
The DB comprising Chief Justice MM Kumar and Justice Mansoor Ahmed Mir after hearing Advocate Virender Bhat Court Counsel and Advocate SS Nanda appearing for the JMC ordered that complete paper book alongwith the status report be furnished to AAG S Shekhar. Adv Nanda stated that he had filed the status report with a copy in advance to the Amicus Curie today.
Upon this Adv Virender stated that for proper adjudication of the issue raised in this PIL, the State of J&K through Secretary, Department of Housing and Urban Development, would be a necessary party. The DB accepted the request and impeded the Secretary, Department of Housing and Urban Development as respondent and issued notice which was accepted by AAG Seema Shekhar who was present in the Court.
