| DB grants 4 weeks time to Div Com Kashmir to divulge names of illegal occupants or appear in person | | AAG filed list of land grabbers of Jammu Division | | ET Report Jammu, Nov 25 (JNF): In the much publicized PIL regarding the alleged nexus of land mafia with the politicians, bureaucrats and police officers, today took a new turn when Additional Advocate General HA Siddiqui appearing for the Revenue Department of the state filed lists of Jammu Division and one District of Kashmir Division in 11 volumes containing the list of the illegal occupants/land-grabbers of State land.Division Bench of State High Court Comprising Chief Justice MM Kumar and Justice Hasnain Massodi after hearing Adv Sheikh Shakeel Ahmed assisted by Advocate Suraj Singh appearing for the PIL whereas AAG HA Siddiqui appearing for the state, took on record the 11 volumes filed in the open Court containing the full details of the illegal occupants of the State land from Jammu Division and one district of Kashmir Division. Division Bench further directed that a copy of each of the volume be furnished to the counsel for the petitioner during the course of the day. During the consideration of the matter AAG HA Siddiqui pointed out that many districts in Kashmir Division are not furnishing the required information in terms of various orders passed by the Division Bench of this Court, Upon this Division Bench directed Divisional Commissioner Kashmir to ensure that before the next date of hearing adequate information is furnished failing which he shall remain present in person.This significant order has been passed in an application filed by Prof SK Bhalla in which he referred a reply to a question in Assembly with regard to illegal occupation of state land by the land mafia in the State of J&K. In the reply submitted by the Revenue Dept substantiated the issue raised in the instant PIL and District wise encroachment of State land running more than 20 lacs Kanals and seeking appropriate direction to be issued to the Commissioner/ Secretary Revenue Dept to submit the detail of all the occupants of State land including the list of all so called VVIPS who have illegally grabbed State land running into lacs of Kanals are indicated in the reply and also seeking constitution of Special Investigating Team comprising of officers having impeccable integrity who should report directly to the State High Court about the action taken in the matter so that the state land under occupation is retrieved. It is worthwhile to mention herein that taking cognizance of this application, earlier the Division Bench had directed State of J&K to divulge the names of the illegal occupants whose detail was filed by petitioner with his application along with the reply of the Revenue Dept in the State Legislature. Division Bench in view of the Public interest involved and urgency fixed the PIL for further hearing for December 23, 2013. |
