| HC seeks status of inquiry against SMC officials | | | S Sabaqat
Srinagar, Dec 6: A Division Bench of Jammu and Kashmir High Court granted further time to Commissioner Srinagar Municipal Corporation (SMC) to file latest status regarding an inquiry initiated against delinquent officers of the body. As soon as the hearing of Public Interest Litigation seeking an end to illegal constructions in the city began before bench of Justice M A Attar and A M Magrey, counsel representing SMC prayed for time till next date of hearing for filing the status report. The court allowed the prayer. On November 28, SMC commissioner was directed by the court to file status report about the enquiry initiated against delinquent officials/officers of the corporation. Meanwhile in compliance to the November 28 order, Hakim Ajaz Ali, Chief Khilafwarzi Officer, filed fresh affidavit about his land measuring 4 kanals and 18 marlas at Rawalpora. In his earlier affidavit there were omission of some survey numbers and as such Deputy Commissioner Srinagar could not file the compliance report about the possession of the land. "The land covered by these survey numbers shall be deemed to be in possession of Deputy Commissioner Srinagar and on 'superdari' of Tehsildar concerned," the court said. On November 21, the court had directed the Magistrate to take the possession of the land owned by the officer. Besides Ali, 95 officials of the Corporation have filed their individual affidavits regarding property owned by them and their spouses and children. The court was hearing the PIL filed by advocate Mujeeb Andrabi which calls for special attention to Srinagar to make it model city keeping in view its historical importance as well as being the face of the Valley During one of the previous hearing, the High Court had ordered sealing of 42 buildings in the city which had come up in violation of the Master Plan. The court had passed the directions after it had been informed that more than 3000 illegal constructions have been reported from across the city. Later, the High Court directed the State government to come up with a policy decision on how to curb the menace of illegal constructions in the city. However, state government informed the court that the matter has been referred to experts before taking any decision. |
