JAMMU, Dec 9 : CJM Ramban M R Chak today awarded one year imprisonment and fine of Rs 5000 to Karnail Singh, s/o Brij Lal, r/o Kela Morh, Ramban who was facing trial in a case of illegal possession/ black marketing of kerosene oil in his shop situated at Kela Morh Ramban.
CJM Ramban after hearing Senior PO Sajad Ahmed for the State whereas Adv ZA Lone for the accused observed that once it is proved that accused was in possession of seized property without lawful authority, permit or licence, the burden of proving that he had such authority, permit, licence or other document to possess the same and therefore he has failed to account for the seized kerosene oil. The argument of Ld. Advocate for the accused that there are major discrepancies which seriously tell upon the merits of the case, is not tenable in as much as even in the statement of a prudent man minor discrepancies here and there are likely to occur. With these observations court awarded one year imprisonment and fine of Rs 5000 to Karnail Singh. JNF |
