| Alleged encroachment of 400 kanals of JDA land meant for EWS at Gole Gujral | | DB directs State, JDA to file reply | | EARLY TIMES REPORT
JAMMU, Dec 9 : The much publicized Public Interest Litigation against land grabbing today took a new turn when a fresh application filed by petitioner Prof SK Bhalla against alleged encroachment of 400 Kanals of JDA Land at Gole Gujral meant for colony of economically weaker sections of the society was taken up for hearing. A Division Bench of state High Court comprising chief Justice MM Kumar and Justice Hasnain Massodi after hearing Adv Sheikh Shakeel Ahmed appearing for the PIL and on his oral request impleaded Jammu Development Authority as party respondent in this PIL and issued notices to Chief Secretary, Financial Commissioner Home, Commissioner/Secretary GAD, Commissioner/secretary Revenue Dept, Divisional Commissioner Jammu, DGP J&K, IGP CID, Deputy Commissioner Jammu and Vice chairman JDA a newly impleaded respondent with a direction to file their replies before the next date of hearing. These notices were accepted in the open Court by Senior AAG Gagan Basotra, AAG HA Siddiqui for the state respondents and Adv Adarsh Sharma for JDA. In the new civil miscellaneous application the petitioner has submitted that a local daily in its issue dated November 30, 2013 carried a news item highlighting encroachment of 400 Kanals prime land belonging to JDA and Revenue Training Institute under Khasra No 746 min situated at Gole Gujral Jammu has been encroached by some elements by first carrying out temporary construction and then turning the same into pacca structures during the past quite long time and despite being aware of this encroachment neither JDA nor any other concerned agency bothered to get the same vacated. It is further contended in the application that the said land is actually meant for the construction of a colony for Economically Weaker Section of the society. It is further submitted that appropriate directions are warranted to the senior functionaries of the JDA and revenue dept to ensure the eviction of encroachers from the prime land in question so that the same is developed for raising the colony for economically weaker sections of the society. The petitioner has also prayed that appropriate disciplinary action is also required to be directed to be taken against the erring officials of JDA and Revenue Dept who remained remiss while discharging their official duties which led to the encroachment of the aforesaid land. Loooking into the urgency involved, Division Bench directed Registry to list this CMA along with the main PIL on December 23, 2013 when the Divisional Commissioner Kashmir will place before the Court the list of the encroachers of State land of the Kashmir Division.
