| Defective Skoda Rapid Car sold to customer | | Consumer Court issues notice to Skoda Auto India, Jainco | | Et Report JAMMU, Jan 19 : The Distt Consumer Forum constituted under the J&K Consumer Protection Act comprising of Distt & Sessions Judge M S Parihar and members Veena Julmeria and K D Sharma, has issued notices to Skoda Auto India Plot no. A-1/1 , Shendra, Five Star Industrial Area MIDC, Tq & Dist Aurangabad 431201 Maharashtra India and Jainco Sivaana Motors, authorized Dealer of Skoda Auto India NH1A, Kartholi Baribrahmna, Jammu, in a consumer complaint filed by a senior citizen Pawan Shastri S/o Late Baldev Dass C/o Hotel Swastik, Gurudwara Sunder Singh Road, Jammu through Advocate A K Sawhney with Aseem Kumar Sawhney and Neeraj Singh. In the complaint, A K Sawhney Advocate and associates have sought for a direction from the Consumer Court to the opposite parties- Skoda Auto India and Jainco Sivaana Motors , authorized Dealer of Skoda Auto India to replace the defective Skoda Rapid vehicle or to refund the price of the vehicle i.e. RS 8,42,249/- with litigation expenses and compensation. It was submitted in the complaint of Pawan Shastri that being influenced by the marketing of the OPs and the advertisements issued in media the complainant was lured and induced to purchase a Skoda Rapid car from the OPs for his personal use. After being induced and lured by the OPs; the applicant obtained a loan from J&K Bank Ltd Residency Road and purchased a Skoda Rapid ABN- MT 1.6 TDI CR for a price of Rs 8,42, 249/- . It was submitted by A K Sawhney Advocate for the complainant that within few months of the purchase of the vehicle the car developed snags and had to be taken to the OP no. 2's authorized workshop, service station where the services were provided from time to time. The problems kept persisting and in December 2013 the complainant faced with a serious car problem, when the yellow indicator light in the car used to light up always indicating a serious technical car snag. The problem in the car again persisted and was not resolved because there was a serious defect in the car which could not be rectified by the OPs and the yellow indicator light kept lighting, and the mechanic of the OPs had advised that the car could catch fire due to this indictor light or engine could cease and therefore the complainant had to stop using the car scared of the repercussions and kept contacting the OPs. But the OP no. no. 2 who had sold the car to the complainant and had earned profits/ his commission out of the sale of the car left the complainant/ consumer in lurch and at the mercy of God. On 20.12.2013 the complainant received a response to his complaint and disclosed that the same had been forwarded to M/s Krishna (Amritsar) purportedly another dealer of Skoda in Amritsar. On receiving this response the complainant contacted the Skoda dealer at Amritsar- M/s Krishna and told them that the vehicle had developed serious defect during guarantee and warranty of the vehicle and as per the company's warranty policy the defect needs to be rectified at the expense of the company, but the dealer gave a cold response stating that he was only a dealer for Amritsar in Punjab and not for Jammu and in case the complainant wants to get the vehicle repaired he must bring the vehicle to Amritsar. Taking cognizance of the complaint, the Consumer court issued notices to the respondents. |
