| Fin Secy asked to appear in person in 'Construction of Distt Court Samba' case | | | ET Report
Jammu, Feb 6 : In a PIL filed by one Ganesh Sharma seeking construction of District Court Complex in Samba, A Division Bench of State High Court today directed Secretary Finance Department to remain present and explain as to why he was not present for today's hearing as direction issued by the Division Bench on December 26, 2013.
Division Bench comprising Chief Justice MM Kumar and Justice Dhiraj Singh Thakur today after hearing Sr Adv Sunil Sethi appearing for the PIL whereas Sr AAG Gagan Basotra appeared for the state directed Senior AAG that he shall seek instructions from the Finance Department as well as from the Secretariat of the Chief Minister with regard to time utilized for sanctioning of funds for Judicial Court Complex, Samba. The Secretary Finance Department shall remain present and explain as to why he was not present for today's hearing as direction issued by the Division Bench on December 26, 2013.
Division Bench further observed that Senior AAG has stated after obtaining instructions from the Secretary, Planning and Development Department, that necessary sanction for release of funds in respect of Judicial Court Complex, Samba has been accorded and the file is now with the Finance Department but there is no status report filed either by the Planning and Development Department or Finance Department and the matter is hanging and waiting.
Further Division Bench directed that Senior AAG shall seek instructions from the Finance Department as well as from the Secretariat of the Chief Minister with regard to time utilized for sanctioning of funds for Judicial Court Complex, Samba. The Secretary Finance Department shall remain present and explain as to why he was not present for today's hearing as was directed in order dated 26.12.2013. Division Bench also directed that the status report shall also disclose the development with regard to constitution of a committee to prepare and finalize the proto type design concerning the construction of Court Complexes in the State of Jammu and Kashmir because in the last order we have noticed that the committee was yet to take a decision and the decision was to be prospective. Court said that Senior AAG Gagan Basotra may also seek instructions with regard to the progress made in that direction and directed Registry to list this PIL on February 13, 2013. |
