| 7 Years RI, Rs 50,000 fine to Narco Smuggler | | | Et Report Jammu, Feb 7 : Principal Sessions Judge Kathua AK Koul today awarded seven years rigorous imprisonment and fine of Rs 50,000 to Narpay Singh S/o Bant Singh who was facing trial in smuggling of contraband poppy straw and issued General Arrest Warrants against Baljeet Singh S/O Gandhor Singh. According to the police case, on 05.04.2007, a police party laid a naka at Kalibari, Kathua, on Jammu-Pathankot National Highway and intercepted a tanker bearing registration No. HR37B-1816, on for checking. The tanker in question was being driven by Narpay Singh, while as Baljeet Singh was sitting inside the tanker. During search of the vehicle, nine kilograms of poppy straw were recovered from a mesh fixed on the front of the vehicle. The consignment of contraband was packed in nine packets weighing one kilogram each. Police registered a case and after completion of investigation presented challan in the Court. After hearing PP Ravi Gupta for the state whereas Adv Ganesh Sharma for the accused, Principal Sessions Judge Kathua AK Koul observed that it is fair to conclude that Narpay Singh was found in conscious possession of nine kilograms of poppy straw, the possession of which he could not justify. So, Narpay Singh appears to be connected with the guilt beyond all shadows of doubt. He is so convicted u/s 8/15 NDPS Act. Principal Sessions Judge Kathua further observed that accused in this case is in the prime of his youth but then the crime committed by him is also grave and so balancing the aggravating and mitigating circumstances, the accused while being convicted under sections 8/15(b) of N.D.P.S Act, is sentenced to rigorous imprisonment of seven years and a fine of Rs. 50,000/-.In case of default in payment of fine the accused shall undergo a further imprisonment for six months.
