Shabir loses legal battle as CJ refuses to hear bail application

JAMMU, Feb 7: The sexual assault by Minister of State for Health, Shabir Khan has caused a stir across the state.
However, according to Congress sources, Omar Abdullah was directed to wait since yesterday as high command consulted the state leadership. Omar's 20-hour wait ended today when he received the nod from Congress High Command. Omar was quick to inform the people on twitter. "I have received the resignation of the Minister of State for Health Shabir Khan and I am forwarding the same to the Governor for acceptance." Omar's letter was accepted by the Governor. A Government press note said: "The letter of resignation of Shabir Ahmad Khan, Minister of State, recommended and forwarded by Omar Abdullah, Chief Minister has been accepted with immediate effect by N.N. Vohra, Governor of Jammu and Kashmir."
Sources said, keeping view the character of the victim, most of the Congress leaders urged the high command to act tough against the erring Minister. The party, it may be mentioned has already lost its goodwill due to G.M Saroori's alleged involvement in swindling money, pending corruption cases against Taj Mohi-ud-Din and exam gate scandal of Peerzada Mohammad Syed's son. The new breed of leaders, insiders said, are out to rid the party of the corrupt leaders to perform better in the forthcoming Lok Sabha and LA elections. Meanwhile, Khan's legal battle to save himself from arrest failed as the Chief Justice disallowed bail application at Jammu. Khan immediately went into hiding to evade arrest. Sources told Early Times that Shabir has to file a bail application in Srinagar High Court to evade arrest. They however, said Shabir was finding it difficult to hire a lawyer in Srinagar as his lawyer who himself is a Congress leader refused to file the application before the Srinagar branch of the J&K High Court. Sources said Khan through his close confidants approached many senior lawyers in Jammu for filing a bail application before the Srinagar branch of the High Court but according to the sources nobody was ready to fly all along to Srinagar today. Sources said Khan's council moved an application in the High Court today but it was not allowed to be filed and turned down by the Chief Justice. They said soon after this development, Khan's close associates tried to convince some lawyers to move the bail application in Srinagar branch of J&K High Court but the lawyers refused to go to Srinagar after which Khan's people approached the Advocate General to use his good offices for hiring a council in Srinagar who would file the application there.
Pertinent to mention a complaint was filed in Police Station Shaheed Gunj on February 6 wherein it was alleged that Shabir Ahmad Khan Minister of State for Health made provocative advances towards her and tried to molest the lady doctor (victim) on 28.01.2014 at Civil Secretariat in a room adjacent to his office chamber and on this the police lodged a case FIR no. 09 U/S 354, 509 RPC dated 06.02.2014 and investigation has been taken up. Keeping in view the nature of allegations arrest of Shabir Khan is compulsory and expected any time.
