| PIL on construction of District Court complex Samba | | HC seeks explanation from authorities | | Early Times Report
Jammu, Feb 13 (JNF): In a PIL filed by one Ganesh Sharma seeking construction of District Court Complex in Samba, A Division Bench of State High Court comprising Chief Justice MM Kumar and Justice Dhiraj Singh Thakur today after hearing Adv Ankesh Chandel appearing for the PIL whereas Sr. AAG Gagan Basotra appeared for the state, took serious note and directs that the details be furnished with regard to expenditure incurred on Administrative Complexes and on the residences of the officers on administrative side and the explanation as to why a different yardstick is being adopted with regard to incurring of expenses on the judicial court complex and the residences of members of Judiciary must also be tendered. When the PIL came-up for hearing, BB Vyas the Finance Secretary has personally appeared in the Court as per earlier direction and apprised the court that final order in regard of sanctioning of funds has been issued yesterday and grants sanction to the estimate cost of Rs 2027 lacs for construction of District Court complex Samba with the prior approval of Planning Dept. Division Bench observed that the status report filed by respondents fails to answer the one basic question posed in the last two orders. In the last but one para of the order dated December 26, 2013, this Court has solicited the response as to whether identical yardstick is applied to administrative complexes, which is fixed for judicial court complexes built in the state and Division Bench observed that there was no answer given and the same direction was also repeated in last order and the status report stated February 12, 2014 filed in the court in response to the aforesaid does not disclose the yardstick adopted for administrative complexes and took serious note and directed that the details b e furnished with regard to expenditure incurred on Administrative Complexes and on the residences of the officers on administrative side and the explanation as to why a different yardstick is being adopted with regard to incurring of expenses on the judicial court complex and the residences of members of Judiciary must also be tendered. Division Bench also directed that the response should be filed within two weeks and state further disclosed that what the allocation of funds to the judicial infrastructure in current budget and in the ensuing budget of 2014-14 and directed Registry to list this PIL on March 5, 2014. |
