Court rejects bail applications of 3 murder accused

Jammu, Feb 15: Principal Sessions Judge Jammu today rejected bail applications of three murder accused facing trial in much publicized Jagti Migrant Murder case.
Principal Sessions Judge Jammu Kartar Singh rejected bail applications of Sumit Singh son of Sham Singh r/o Tool Post, Nagrota, Jammu, Gourav Partap Singh alias Shanki son of Ved Parkash r/o Panjgrian, Tehsil Jammu and Naresh Kumar son of Dwarka Nath r/o Kandoli Nagrota, Jammu facing trial in Jagti Migrant Murder case.
After hearing Sr Adv BS Slathia and Adv Ajay Vaid appearing for the petitioners whereas Public Prosecutor Shabir Choudhary appearing for the state, Principal Sessions Judge Jammu Kartar Singh observed that this case vide order dtd 8/2/2014, charge has been altered from section 302 RPC to 304 Part II RPC, whereas formal charges are yet to be framed. In case the petitioners are released on bail, the release may complicate the matter, court observed and added not only this, the trial of the petitioners has yet to be started and in case they are admitted to bail, the possibility cannot be ruled out that they may temper with the prosecution evidence as the charges framed against them are serious in nature. "Since the trial of the case has not commenced and not even a single witness has been examined, it is not deemed proper to release the petitioners on bail at this stage, court observed and with these observations it rejected the bail applications of above three accused. According to the police case that on 4/8/2013 the complainant Ankush Talashi lodged a written report in police station Nagrota stating therein that on that day at about 7.0pm, he along with his father namely Tej Nath Talashi and uncle Pyare Lal Talashi were on evening walk towards Fly over Jagti and when they were intercepted by a vehicle bearing regd no.JMU-7778 in which four persons were traveling and out of which three were known to him and their names were Sumit Singh son of Sham Singh, Naresh Kumar Sharma son of Dwarka Nath and Gourav Partap Singh son of Ved Parkash and one more person. They occupant of vehicle alighted from the vehicle and forcibly tried to kidnap him on account of old enmity, he complained and had added when his father resisted and raised alarm, they threatened to kill him. However his father tried to save him but three of them caught hold of his father and one of them namely Sumit Singh hit his father with sharp edged weapon inflicting him serious injuries. He was shifted to GMC Hospital for treatment in critical condition. On the written report of complainant FIR No.249/2013 for the commission of offence falling under section 307/364/34 RPC r/w 4/25 Arms Act was registered and Dy.SP, Khaliq Hussain Choudhary started investigation. During investigation, the injured Tej Nath Talashi succumbed to the injuries in the hospital and offence under section 302 RPC was added. (JNF)
