| Alleged Involvement of BJP MLA, his brothers in Murder case | | HC issues notice to DGP & Ors, directs respondents to file objections within 2 weeks | | ET Report Jammu, Feb 19 (JNF): In alleged murder of contractor Raj Singh whose dead body was found on March 30, 1999 in which Dina Nath father of the deceased filed a petition in High Court seeking direction to the respondents to entrust the investigation of FIR NO 44/99 registered by P/S Jhajjar Kotli u/s 302 RPC to CBI for investigation and also seeking security to the petitioners particularly the Sham Singh Contractor other son of the petitioner, took new turn when Nand Kishore Sharma brother MLA Jugal Kishore filed petition to seek permission to array as party respondent and oppose the petition by filling objections. Justice Bansi Lal Bhat of J&K High Court Jammu Wing after hearing Sr. Adv Sunil Sethi with Adv Veenu Gupta for the petitioner issued notice to State of Jammu & Kashmir through Commissioner/Secretary Home, DGP J&K, IGP Jammu Division, DIG Jammu-Kathua Range, SSP Jammu, Additional SP Rural, SHO P/S Jhajjar Kotli and Incharge Police Post Manwal and directed respondents to file objections within two weeks. In the petition filed by father of deceased it has been submitted that on April 13, 1995 M/S Jugal Kishore, Nand Kishore, Naresh Kumar and Ganesh Kumar @ Munna sons of Bal Krishan and two others attacked on Sham Singh at Kishenpur Chowk with sharp edged weapon. A report was lodged and FIR NO 35/95 was registered by the P/S Jhajjar Kotli u/s 307/148/34 RPC r/w section 4/27 Arms Act but till date the injured has not be summoned for recording his statement despite the request made to SHO Jhajjar Kotli. It was further alleged in the petition that on March 30, 1999, the petitioner came to know at about4:00 PM that the dead body of his son namely Raj Singh was lying near national Highway Road Bridge Krishanpur. The police Jhajjar Kotli came on spot and seized the dead body and started inquest investigation u/s 174 CrPC and a case under FIR No 44/1999 has been registered u/s 302 RPC. It has been alleged in the petition that Raj Singh had told the family members that Jugal Kishore and his brothers had threatened him that he should no refrain from undertaking the work of protection wall around the pillars of Railway Bridge at Kishenpur. The petitioner told the police that they suspect the involvement of Jugal Kishore and his brothers in the murder of Raj Singh. In the petition it has been submitted that in the facts and circumstances of the case the investigation in the FIR NO 44/1999 u/s 302 RPC is not being conducted properly and effectively for more than 12 years and therefore, facts and circumstances of the case speaks volume about the undue influence being exercised by Jugal Kishore MLA and his brothers even the Investigating Officer is not implementing the orders passed by the Magistrate from time to time and seeking CBI enquiry in the said case. |
