Desiliting issue: DB directs Secy H&U Deptt to convene meeting of JMC, Others

Jammu, Feb 20 (JNF) : In a Public Interest Litigation (PIL) filed by General Public of Jeevan Nagar and others for desilting and cleaning of Nallah popularly known as lundi Chaoi, Division Bench of state High Court comprising Chief Justice MM Kumar and Justice Dhiraj Singh Thakur today directed Secretary to Government, Housing and Urban Development Department convene the meeting of JMC and Cantonment Board for to find solution of the problem.
Division Bench after hearing Adv Abhinav Sharma appearing for the petitioner whereas AAG Seema Shekhar appearing for the state impleaded Secretary to Government, Housing and Urban Development Department is as party respondent, AAG Seema Shekhar accepts notice on behalf of the newly added respondent. Division Bench further observed that there may be some dispute with regard to the areas of jurisdiction between the Municipal Corporation and Cantonment Board. Upon this Division Bench directed that Secretary to Government, Housing and Urban Development Department to find solution of the problem by convening meeting of both the bodies so that basic object of casting obligation on them to give clean environments to the residents may be achieved. It directed that Secretary to Govt. Housing & Urban Development Department may convene the meeting within two weeks and delineate the areas among both the establishments. Division Bench further directed that the minutes of the meeting and the decision taken be placed before this Court on or before March 12. This Public Interest Litigation has been filed by one Om Praksah Shrama regarding the problem of general hygiene in the city of Jammu with special reference to the Nullah known as Landoi Choi between Jeevan Nagar and Narwal Pain. It appears that the Municipal Corporation or the Cantonment Board has not been able to effect any de-silting process as a result the Nallah over flooded flooding the road and residential area.
