| HC directs GAD to file objections | | PIL seeking admission of trans-gender children in private schools | | Early Times Report Jammu, Mar 5 : In a PIL filed by Mian Haji Saria seeking direction to the respondents to ensure compliance of Fundamental "Right to Education" in letter and spirit and also directed private educational institutions do not discriminate qua the "Trans-Genders" for the purposes of admitting them in Education Institutions while treating them as aliens. Division Bench of State High Court Comprising Chief Justice MM Kumar and Justice Muzaffar Hussain Attar after hearing Adv DS Chouhan appearing for the PIL granted one month's time to General Administration Department for filling objections. In the PIL it has been submitted that the petitioner approached private schools for admission of two trans-genders namely Komal and Shammiu, after purchasing the admission forms, but suffered humiliating defeat when denied admission on the basis of their being "Trans-genders" consequent whereupon their educational career has been put to jeopardy because of discriminatory attitude of the management of private institutions. In the PIL it has been challenges the action of the respondents in depriving the trans-genders community of fundamental right to education by not admitting them in the educational institutions for pursuing their academic career and treating them as aliens and complains gross abuse of process of law by State of J&K having duty to enforce or administer law and seeking direction to private educational institutions to admit the "trans-genders" children in their institutions.
