| SIC directs RTO Jammu to allow inspection of records | | | Early Times Report
Jammu, Mar 5 : The State Information Commission (SIC) has directed the Regional Transport Officer (RTO) Jammu to allow inspection of official records pertaining to issuance of driving licenses by an information seeker. According to details available one Raj Kumar S/o Anant Ram R/O Gurah Brahmana, Jammu moved an application under J&K RTI Act, 2009 before the PIO / Regional Transport Officer, Jammu in which he has sought varied information regarding driving licence etc. The application of the information seeker was received in the office of PIO on 07-08-2013. The PIO provided the requisite information to the applicant vide letter no. 474/MVD/RTOJ/13-14 dated 02-09-2013. Subsequently the applicant was also provided some additional information on driving tests conducted during the month of June & July vide office letter no. MVD/RTOJ/2013-14/527 dated 12-09-2013. This information consisting of 219 pages was handed over to the applicant as is evident from the receipt of the information signed by the applicant. However, the applicant was not satisfied with the information provided to him filed 1st appeal before the FAA/Transport Commissioner, Jammu. The First Appellate Authority (FAA) cum Transport Commissioner, Jammu vide office letter no. TC/JK/RTI/7806-07 dated 12-12-2013 directed the PIO/RTO, Jammu to provide the complete information to the applicant. The PIO/RTO, Jammu vide office letter no. 9051-52/RTOJ/PA/29-11-2013 intimated the applicant that the information sought by him had been provided on all accounts except with regard to learner's licence numbers, detail of fees and permanent driving license fee as the same was extremely voluminous and difficult to extract/compile from the system. Feeling aggrieved of the aforesaid response from the office of the PIO/RTO, Jammu, the information seeker filed 2nd appeal dated 31-12-2013 before the Commission in which he has alleged that he has not received any information from the office of the PIO/RTO, Jammu. The PIO/RTO, Jammu vide his counter statement no. 114/RTOJ/PA/2014 dated 24-01-2014 informed the Commission that the requisite information as available in his record has been furnished to the information seeker. The PIO further submitted that the applicant has also been intimated that U/s 7(9) of the J&K Right to Information Act, 2009 with regard to learner's licence numbers, detail of fees and permanent driving licence fee could not be provided as the same was extremely voluminous and difficult to extract/compile from the system and its compiling would disproportionately divert the resources of the office at the cost of routine work. The PIO/RTO, Jammu further submitted before SIC that he requested the applicant to visit the office for any information pertaining to this matter on any day and ascertaining any facts he may require from records which would be made available to him in the office. " In view of the aforesaid facts and submissions made by the PIO/RTO, Jammu, it is hereby ordered that in case the information seeker desires to inspect the record in the office of the RTO, Jammu he may be provided the facility to do the same during office hours on a working day and also provide him photocopies of the relevant documents free of cost, if any, required by him. The parties are at liberty to settle the date and time for inspection of record in the office of RTO, Jammu which may be convenient to them" reads the SIC order. |
