| PIL over low conviction in NDPS | | DB directs IG Crime to file status report | | Jammu, Mar 7(JNF): A Criminal Acquittal Appeal treated as PIL regarding low conviction in NDPS Cases, Division Bench (DB) of State High Court comprising Chief Justice MM Kumar and Justice Muzaffar Hussain Attar directed IG Crime to file status reports with regard to the steps so far taken within four weeks so that the acquittal rate which is present at 92% is brought down. Earlier the Division Bench took serious note for low conviction in NDPS Cases and observed that almost every day acquittal appeals are filed by the State against many orders passed by the trial Courts and it is revealed that on account of non production of material witnesses' prosecution has failed. After hearing Sr Adv Sunil Sethi who has pointed out that the committee (constituted vide order No.1257 of 2013 dated 07.05.2013 with Javed Geelani, IGP Crimes, as Chairman) has collected data from all the districts with regard to NDPS cases and the data is yet to be analyzed in order to reach to the bottom of the causes which result in acquittal of NDPS accused. There are also suggestions made by the Counsel for the PIL and the copy of the same shall be furnished to the IG Crime. |
