| Induction in KAS of Secys' to Judges of High Court case | | Law Secy asked to file affidavit regarding steps taken on recommendations from Reg Gen | | Early Times Report
Jammu, Mar 7 : In a petition filed by Secretaries of J&K High Court Judges seeking direction to State respondents to consider and treat the services of the petitioners category as one of the feeding service for induction into KAS, as has been done in favour of their counter parts working in the Civil Secretariat in terms of SRO386/2008, Justice Tashi Rabstan of J&K High Court Jammu Wing directed Law Secretary to file an affidavit before the next date indicating the steps taken on the recommendations dated May 28, 2012 sent by Registrar General of J&K High Court to him. After hearing Sr Adv Sunil Sethi appearing for the petitioners whereas Sr AAG Gagan Basotra for the state, Principal Secretary to Finance Dept arrayed as party respondent and notice was accepted by the Sr. AAG for the newly added respondents. While arguing the case, counsel for the petitioner submitted that the petitioner's category attached by Judges of this Court has already been treated as par with their counterparts attached with the minister and the mater already stands decided by Apex Court. He further submitted that whatever benefit is given to the counterparts of the petitioners category, has to flow to them also. It is further stated that counter parts of the petitioners' category have been given benefit of induction into KAS and subsequent high grades in terms of SRO 368/2008 dtd December 12, 2008, which benefit has been denied to the petitioner category. It is also submitted that recommendation have already been made by the Registrar General of J&K High Court to Secretary to Govt Dept of LJ&PA vide order dated May 28, 2012, but no action has been taken by the respondent state for release of benefit to the petitioners category as have been granted to their counter parts. Upon this Justice Tashi Rabstan directed Sr. AAG Gagan Basotra appearing for the respondent to file an affidavit of Secretary to Govt Dept of LJ&PA indicating the steps taken on the recommendations made by the registrar General to him and directed Registry to list this PIL on April 1, 2014. In the petition it has been submitted that the petitioners presently placed in the grade of Rs.10000-15200/- (unrevised), which was released in their favour in October, 2008, after they were substantively promoted as Secretaries, in pursuance to the reorganization scheme of the High Court, in compliance to a judgment passed by the Writ Court upheld by a Division Bench of this Court in the year 1990-91, when the counter parts of the petitioners working in the Civil Secretariat attached with the Ministers/M.Ps/Head of Departments, were released certain benefits regarding higher pay scales with designation, and this benefit was being denied to the petitioners category working in the High Court and as no step in this regard was initiated by the Registrar General J&K High Court, regarding creation of posts in the High Court in the higher grades jeopardizing the rights of the petitioners category and a writ petition bearing SWP No.987 of 1991 titled Mohan Lal Hakim and others v. State and ors was filed in this regard. |
