| Zanana Park girl burn case: Complainant alleges unfair investigation | | 4 witnesses recorded in 4 months, accused still walks free | | Early Times Report
JAMMU, Mar 31: In the infamous burning case of a girl in Zanana Park , Lal Zohra wife of Mohd Aslam - the mother of the victim girl (now dead) has alleged unfair investigation by the Jammu Police.
She had filed a complaint under section 302 RPC against accused Sanjay Sharma son of Hans Raj Sharma r/o Village Mohalla Teh and Distt Doda through Advocate A K Sawhney with Aseem Kumar Sawhney and Mansoor Manhas Advocates filed a petition in the Court of CJM Jammu alleging unfair and tainted investigations and sought monitoring of the investigations in the matter.
The CJM Jammu Mr S C Katal after hearing the counsels had called for the Police report and pursuant to the Court directions the Investigating Officer appeared in person in the Court on Monday alongwith status report and CD file of the case.
As per the Status report filed in the Court the Police has recorded only 4 witnesses in four months and after the death of the girl the Police has not added the offence of 302 RPC in the case and has failed to arrest the accused, the counsel for the complainant A K Sawhney submitted.
It may be mentioned that the Chief Judicial Magistrate Jammu after hearing the counsel for the
complainant A K Sawhney and after going through the complaint forwarded the same in original to the SHO Police Station Pacca Danga Jammu with a direction to proceed under law and investigate the matter expeditiously in December 2013 but till date as per the allegation of the petitioner the accused has not been arrested in a case which should be now converted into Section 302 RPC.
In the complaint it was alleged, that complainant is a hapless mother whose young daughter has been murdered by the accused in connivance and conspiracy with certain other accused, and the Police is hand in glove with the accused since the accused's brother is an Inspector in the Police department and posted as SHO Police Station Gandhi Nagar Jammu.
It was alleged in the complaint that the family members of the of the victim/ deceased were busy in her treatment and on20.9.2031 and 21.9.2013 concerned IO in conspiracy with the other Police officers destroyed the evidence to shield the accused. Thereafter police did not do any investigation and so called statement of victim recorded was made the basis for lodging the FIR. Even thereafter police was supposed to do further investigation and record the statements of victim, her relatives and other family members and eye witnesses, but they did not approach any one of these people leaving the investigation in lurch. On seeing this attitude the complainant approached the Special Municipal Magistrate Jammu through his brother in law for direction to the Police for recording fresh statement of the victim by the Judicial Magistrate and for filing the status report. The Learned Special Municipal Mobile Magistrate Jammu vide order dated 27.9.2013 directed the IO to record the statement of victim forthwith in the aforesaid case possibly on that day itself by the magistrate to avoid any untodo incident.
The Police delayed the recording of the statement of the victim (now dead) and by that time the accused obtained a stay order from the Pr Sessions Judge in a Revision so filed. That Revision was dismissed by the Court on 9.10.2013.
In the complaint filed by mother of the deceased, it was alleged that despite the fact that the Police is now let free by the High Court to use the statement of the victim (now deceased) under law as the petition of the accused has been dismissed and a bare perusal of the statement recorded by the Judicial Magistrate Ludhiana (now dying declaration) reveals that the accused has murdered the deceased, still the Police concerned has not bothered to book the accused under section 302 RPC for murder or has arrested the accused.
The accused is leisurely enjoying his life under the patronage of his brother being an officer of the Jammu Police, under the support, connivance and abetment of the other conspirators who are officers of the Police department, therefore she filed the murder complaint herself to seek justice for her daughter. |
