| SIC orders inspection of revenue record by RTI applicant | | Mutations attested under sec 121 of Land Revenue Act | | Early Times Report Jammu, May 4: The State Information Commission (SIC) has directed the district administration Udhampur to allow inspection of revenue record pertaining to land located at Bharat Nagar Udhampur by an applicant under J&K RTI Act 2009 . The information was earlier denied by the district administration which includes DC as well as Tehsildar office Udhampur. The documents available with Early Times reveal that an appeal under J&K RTI Act 2009 was moved by one Parshotam Singh, R/O New Barrian Bharat Nagar, Udhampur who had filed an application dated 26.09.2013 under Jammu & Kashmir Right to Information Act, 2009 before the Public Information Officer (PIO) cum Additional Deputy Commissioner, Udhampur where-in he sought to know the Details of families residing or in occupation of land in Bharat Nagar before the Bandobast and after the Bandobast, details of the same be may given, in the Bharat Nagar new Barrian in Ward No.1 & 2; Number of mutations attested under section 121 of Land Revenue Act (LRA) at Village Bharat Nagar New Barrian Ward No.1 & 2 and after the Bandobast; Name of authority who has attested the mutations under section 121 LRA after the Bandobast; Number of families not given the benefit of LRA 121 in village Bharat Nagar ward No.1 &2 new Barrian ; Number of families which have been left behind, and the reason thereof. The RTI application of the information seeker was transferred from DC office Udhampur to Tehsildar Udhampur with the direction to provide the information to the information seeker directly within the stipulated time. The Assistant Public Information Officer/Tehsildar, Udhampur vide office No.1271-72/OQ dated 26.11.2013 furnished the requisite information to the information seeker. Meanwhile the information seeker preferred first appeal dated 20.11.2013 before the Deputy Commissioner, Udhampur. During the course of proceedings held on April 25th 2014 at State Information Commission (SIC) office Jammu, the appellant pleaded that the information which have been furnished to him is incomplete and not as per his RTI application and also alleged that it has been intentionally delayed. The Tehsildar, Udhampur submitted before the Commission that the information with respect to revenue record is maintained in the form of Jamabandi/ Record of Rights/Khasra Girdawari for a specific village for land owners/cultivators and not for families. Therefore, information regarding families/wards/habitations does not co-relate with revenue village. The Tehsildar, Udhampur/APIO further submitted that applicant may seek copies of available revenue record by depositing requisite fee and in case the applicant wants to inspect the record he can be provided such opportunity within the purview of Right to Information Act, 2009. The SIC in its order dated April 25th 2014 observed " Perusal of the above said facts shows that there is no intentional delay or malafide in providing the information as alleged by the information seeker. Keeping in view the aforesaid facts and observations, the Tehsildar, Udhampur/APIO is hereby directed to allow the appellant an opportunity to inspect the record in his office on 30th of April, 2014 during office hours and in case the appellant requires the certified copies of available revenue record that may also be provided to him on payment of requisite fee as prescribed in the revenue laws. Tehsildar territorial is further directed to file compliance of this order" |
