| Life-sentence awarded to HM ultra for murdering 'Sarpanch' | | | Jammu, June 4: Principal Sessions Judge Bhaderwah MK Sharma today awarded life-imprisonment and fine Rs 5000 to one Hizb-ul-MUjhadeen (HM) terrorist namely Tariq Mattoo Code Gorkha of Soti Gandoh who was facing trial for murdering Sher Mohammad Sarpanch village Changa. Court also took strong notice of faulty investigation in this regard and passed strictures against police on faulty investigation.
Court awarded life-imprisonment and fine Rs 5000 to accused Tariq Mattoo Code Gorkha S/O Ghulam Nabi Mattoo R/O Soti Gandoh for murdering Sher Mohammad Sarpanch Changa and issued general arrest warrants against two others alleged HM terrorists namely Irfan Ali Code Babloo and Jan Mohammad Code Hamza.
After hearing Public Prosecutor Fareed Ahmed Beigh and Advocates N K Gupta & Shekhar Mehta for the accused person, Principal Sessions Judge Bhaderwah observed that faulty investigation cannot alone be ground to acquit the accused in presence of strong evidence implicating the accused and hold accused Tariq Matoo guilty of commission of offence punishable under section 302 r/w section 34 RPC.
Observing this is a case of murder of a Sarpanch of the village without any enmity but with an intention to create terror, the Court convicted the accused and sentenced imprisonment for life and fine of Rs 5,000/- for the commission of offence u/s 302/34 RPC, bedsides issuing general arrest warrants against alleged HM terrorists namely Irfan Ali Code Babloo S/O Shafqat ali Bhat R/O Kilhotran, Jan Mohammad Code Hamza S/O Hasham Din R/O Pura Pain. Taking strong notice of faulty investigation, Court said that state is therefore, required to direct the police heads of the districts to institutionalize the investigation so that criminal justice system delivers to the masses what has been contemplated in the constitution
According to the police case that on July 4, 2002 at 9.30 pm an information was received in PS Gandoh from reliable sources that terrorists Irfan Ali Code Babloo, Jan Mohammad Code Hamza and accused Tariq Matoo Code Gorkha entered the house of Sher Mohammad Rather, Sarpanch Halqua Changa and fired on Sher Mohammad killing him on spot. The terrorists after killing the deceased kept one IED nearby to cause damage to lives of security forces. On the strength of this report FIR No.57 for the commission of offences u/s 302 RPC, 7/27 A.Act and 3.PSS Act was registered in PS Gandoh. After completion of investigation challan was presented.
