| Sexual assault: Police exonerates Director Health Kashmir | | | Early Times Report
Srinagar, June 27: Police today exonerated Director Heath Services Kashmir, stating that allegations of sexual assault leveled against him by a nurse last month could not be proved. Official sources said that Police Station Shaheed Gunj filed the final report of investigation as "not proved" against the accused in a court here. A departmental enquiry has already exonerated the Director Health Service Kashmir Dr Saleem-ur-Rehman of the allegations. On Tuesday, the Investigating officer of the case had said that no concrete evidence has been found so far which establishes the allegations leveled by the nurse against the DHSK and three others medical officers. In the complaint, the victim has named besides Dr Saleem-ur-Rehman, Dr Nazir Shadad (CMO Anantnag); Dr Arshid Tak (BMO Sallar) and Dr Ashraf (Incharge Medical Superintendent Seer Anantnag) as the accused. The complainant nurse had said that the accused were guilty of very serious misconduct and the allegations against them are "penal in nature but the police is brushing aside the seriousness of the allegations and are helping the accused in fleeing from burnt of investigation." "The contents of the complaint disclose section 376 (punishment for offence of rape) read with section 511 (punishment for attempting to commit offences punishable with imprisonment for life or other imprisonment), 506 (punishment for criminal intimidation), 354 RPC (assault or criminal force to woman with intent to outrage her modesty) and also 501 of RPC," nurse's counsel had said. "But the SHO concerned, to dilute complaint of the complainant, booked the accused in a much lighter offence (section 354-A RPC). The SHO appears to be under influence of the four accused," the counsel has said, alleging that the IO has not been conducting the Investigation in a fair and transparent manner. "The complaint is not being taken cognizance of in its real spirit and scope which has prejudiced the legal rights of the complainant and in the process a wrongful gain is being provided to the accused." |
