HC quashes PSA of JKLF founder's brother

Srinagar, July 9: Jammu and Kashmir High Court has quashed detention order under Public Safety Act against Zahoor Ahmad Bhat, brother of JKLF founder, Maqbool Bhat who was hanged in Tihar jail in 1984.
"Examining the present case on the touch stone of the settled position of law, there are specific averments made in the petition that detenu was not supplied the materials relied upon by the detaining authority.
No other material as referred to in the order of detention, are shown to have been supplied to him. Further, the grounds shown to have been served on and supplied to the detenu are in English language.
On these counts alone, the detention of the detenu is vitiated, he having been prevented from making an effective and purposeful representation against the order of detention," the court observed and quashed the detention order DMB/PSA/07 of 2014 dated March 29, 2014.
In her habeas corpus petition, Bhat's aged mother had submitted that her son was never released since his arrest by the police in the Keran sector of Kupwara in October 2013 and was thereafter booked twice under the PSA.
