DB dissatisfied over compliance report on 'beggary menace'

Jammu, Aug 7 : In a Public Interest Litigation (PIL) filed by practicing Lawyer Adv Parimoksh Seth seeking directions to the respondents to implement the provisions of the Prevention of Beggary Act, 1960 and to stop the menace of begging especially organized begging in the State of J&K, Division Bench (DB) of State High Court observed that the compliance report filed does not satisfactorily answer various issues raised in the directions already issued and directed to file fresh compliance report within four weeks.
The Division Bench Comprising Chief Justice MM Kumar and Justice Dhiraj Singh Thakur after hearing Sr. Adv Sunil Sethi with Adv Ankesh Chandel for the PIL whereas Sr Additional Advocate General Gagan Basotra with Govt Adv Meenakshi Bhutyal for the State, expressed its dissatisfaction with compliance reports regarding the directions already issued and directed respondents to file fresh compliance report within four weeks.
Division Bench also directed finance department shall place adequate funds at the disposal of the department of home or the Director General of Police, J&K Police so that there is effective mechanism in place as per the provisions of the Beggary Act. Earlier when Public Interest Litigation was taken-up hearing today, Division Bench observed that this Court already issued comprehensive directions in order dated March 6, 2014, which are reiterated. Court further observed that some steps have been taken by the State but no concrete outcome is available and thus directed that at the earliest effective steps be taken to implement the provisions of the Beggary Act as already directed in order dated March 6, 2014.(JNF)
