ET Report SRINAGAR, Aug 7: The Jammu and Kashmir High Court today issued a notice to Government on a petition filed by a nurse, seeking directions for constitution of a committee to conduct an enquiry into her allegations against Director Health Services Kashmir and three other doctors under the prevention provisions of the Sexual Harassment of Woman Act at Work Place. The notice with the direction to file reply within four weeks was issued by a bench of Justice AM Magrey after hearing the petition by the nurse. Apart from DHSK Dr Saleem-ur-Rehman, the nurse has alleged molestation attempt on her by Dr. Nazir Shahdad, Chief Medical Officer, Anantnag, Dr. Arshid Hussain Tak Block Medical Officer Sallar Pahalgam and Dr. Ashraf Padder Assistant Surgeon, SDH Seer Anantnag. The official respondents include State Government through Chief Secretary and Commissioner Secretary to Government Health and Medical Education Department. On June 27, Police exonerated the DHSK and others, stating that allegations of sexual assault leveled against them by the nurse could not be proved. After the complaint by the nurse, Police Station Shaheed Gunj had registered a case under section 354-A (assault or criminal force to woman with intent to outrage her modesty) of RPC against officers. Subsequently, the nurse moved the court of Chief Judicial Magistrate by filing a complaint, seeking directions to police to register a case under RPC Sections of 376 (punishment for offence of rape), 511 (punishment for attempting to commit offences punishable with imprisonment for life or other imprisonment), 506 (punishment for criminal intimidation) and 354 (assault or criminal force to woman with intent to outrage her modesty). A departmental enquiry has already exonerated the Dr Saleem-ur-Rehman of the allegations. |
