| DB issues notice to CS, Secy GAD, DC Kathua & Ors | | PIL seeking quashment of back door appointments in Engineering departments | | Jammu, Oct 9: In the Public Interest Litigation filed by one Shiv Shanker Sharma seeking quashment of backdoor appointments in engineering departments of the state, a Division Bench of State High Court Comprising Justice Ali Mohammad Magrey and Justice Bansi Lal Bhat of J&K High Court Jammu Wing after hearing Adv SC Mansotra appearing for the PIL issued notice to Chief Secreatry J&K, Commissioner/Secretary GAD, Executive Engineers PHE, Irrigation, Flood Control, PWD, M&RE, PHE mechincal of District Kathua and Deputy Commissioner Kathua returnable within two weeks.
In the present PIL, petitioner filed writ of certiorari so as to hold the J&K Civil Services (Special Provisions) Act, 2010 dated April 28, 2010 as ultravires to the constitution of India violating the spirit of Article 14 & 15 of the Constitution of India as made applicable to the state of J&K and consequentially quash/cancel the appointments given illegally through backdoor, depriving various lawful and eligible aspirants from public employment, arbitrarily in serious and transgression of the constitutional and legal sanctity of the law of land. |
