BCI report rattles Kashmir, critics term it biased, lop-sided

JAMMU, May 1: Supreme Court-appointed 5-member Bar Council of India (BCI) team's April 22, 2018 16-page report on the Kathua case has rattled people and parties in Kashmir. They have described the BCI's report as a carbon-copy of the affidavit submitted by J&K HC Bar Association, Jammu, to the Supreme Court of India and dismissed the report of the BCI as "lop-sided" and biased".
"The BCI report has come under scathing criticism. The mainstream camp in J&K (read Kashmir) has come down heavily on the BCI for 'lop-sided' and 'biased' report," reports emanating from Srinagar said.
"The Bar Council of India's report to the Supreme Court is a copy of the counter-affidavit by the Jammu Bar Association in the apex court," reports further said, adding that the BCI team didn't take cognizance of the fact that there was an "obstruction caused by Kathua lawyers to prevent Crime Branch (CB) from filing charge-sheet in rape and murder of a child in the district".
What really has rattled the people and politicians, including separatists, in Kashmir? The BCI's four observations and one suggestion have rattled them. The BCI has much to the chagrin of members of a particular community and Kashmiri leaders of all hues, barring Kashmiri Hindu leaders, favoured CBI probe into the Kathua rape and murder.
"The demand for a CBI probe by the public, members of the civil society, Jammu, and by the Kathua Bar Assocition and J&K High Court Bar Association appears to be justifiable," the report has said.
"The media has mis-reported the entire episode, especially, relating to the conduct of the advocates of Kathua Bar Association and Jammu & Kashmir High Court Bar Association. The media has wrongly reported that the Kathua Bar Association and the J&K High Court Bar Association are siding with the accused," the report has said.
The BCI report has questioned the very credentials of the so-called social activist Talib Hussain and suggested that his "credentials needed to be verified". So much so, the BCI has questioned the very composition of the Crime Branch team and said there was an alleged murderer of a boy and rapist of his sister in the police station was on the team and that the manner in which it conducted investigation was "shoddy".
All these have, it appears, upset the apple-cart of those who wanted the accused to be condemned unheard. But more than that, the BCI's clean chit to Jammu lawyers, critical remarks against the Crime Branch team, social activist Talib Hussain and recommendation of CBI probe into the Kathua case has changed the whole narrative and put the members of a particular community on the defensive and rendered Kashmiri leaders and Kashmiri lawyers clueless.
